Terms of Service

Effective date: October 18, 2026

1. Acceptance

These Terms of Service ("Terms") are an agreement between you and MCAG Technologies LLC ("MCAG", "we", "us"), a Florida limited liability company. They govern your use of InspectIQ and the website mcagtech.com (together, the "Service"). By creating an account, subscribing to or using the Service, you agree to these Terms. If you use the Service on behalf of a business, you represent that you are authorized to accept these Terms for that business, and "you" refers to that business.

Our Privacy Policy explains how we handle personal information and forms part of these Terms.

2. The service

InspectIQ is an inspection report platform for licensed Florida home inspectors. It lets inspectors manage inspections, capture findings and photos, and generate reports such as four-point, wind mitigation and full home inspection reports. AI-assisted drafting (beta, not yet generally available) is in development.

We may improve, change or discontinue features of the Service from time to time. If we make AI-assisted features available to you before general availability, they are provided for evaluation, may change or be removed, and may not perform as reliably as other features.

3. Accounts

  • InspectIQ is intended for licensed home inspectors and their businesses.
  • You must provide accurate account information and keep it up to date.
  • You are responsible for keeping your login credentials confidential and for all activity under your account.
  • Notify us promptly at ops@mcagtech.com if you believe your account has been accessed without authorization.

4. Subscriptions and payment

  • Plans. InspectIQ is offered as a monthly subscription. Plans range from $49 to $349 per month. The price of your plan is shown when you subscribe.
  • Billing. Subscriptions are billed monthly in advance and renew automatically at the start of each billing period until cancelled. Payments are processed by Stripe, and you authorize us, through Stripe, to charge your payment method for each billing period.
  • No free trial. The Service does not include a free trial.
  • Cancellation. You can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then.
  • Refunds. Fees are not refunded for partial billing periods, unless required by law.
  • Taxes. Fees do not include taxes unless stated. You are responsible for applicable taxes, other than taxes on MCAG's income.
  • Price changes. We may change prices with reasonable advance notice. A change applies from your next billing period after the notice, and you may cancel before it takes effect.
  • Non-payment. If a payment fails, we may suspend access to the Service until the balance is paid.

5. Acceptable use

You agree not to:

  • use the Service in violation of any law or regulation, including professional licensing rules;
  • upload content you do not have the right to use or share, or that infringes others' rights;
  • upload malware or attempt to disrupt, overload or impair the Service;
  • attempt to access accounts, data or systems that you are not authorized to access, or bypass security or tenant isolation controls;
  • reverse engineer, copy or resell the Service, except as allowed by law;
  • use the Service to produce reports that are false or misleading, or that you are not licensed to issue.

6. Customer content and ownership

"Customer Content" means the information you enter or upload to the Service, including property addresses, photos, findings, client information and reports.

  • You own your content. As between you and MCAG, you keep all rights in your Customer Content.
  • License to us. You grant MCAG a limited license to host, process, copy and display Customer Content only as needed to provide, secure and support the Service, and as described in our Privacy Policy.
  • Your responsibilities. You are responsible for your Customer Content and for having the rights, notices and consents needed to upload it, including information about your clients and photos of properties.
  • Deletion. When your account is closed, we delete Customer Content as described in our Privacy Policy.

7. AI-assisted drafts

InspectIQ's AI-assisted drafting (beta, not yet generally available) is designed to help draft and review report content. AI-generated drafts may be incomplete or inaccurate. Every AI-generated draft must be reviewed by the licensed inspector, who approves every report. The licensed inspector remains solely responsible for the content, accuracy and professional conclusions of the final report, and for compliance with applicable licensing and reporting requirements. MCAG does not perform inspections and does not provide professional inspection opinions.

8. Intellectual property

The Service, including its software, design, documentation and trademarks, is owned by MCAG and its licensors and is protected by intellectual property laws. Subject to these Terms and payment of fees, we grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription for your internal business purposes. If you send us feedback or suggestions, we may use them without obligation to you.

9. Confidentiality

Each party may receive non-public information from the other that is marked confidential or that a reasonable person would understand to be confidential ("Confidential Information"). Customer Content is your Confidential Information. The receiving party will use Confidential Information only to perform under these Terms, will protect it with reasonable care, and will not disclose it except to employees and service providers who need to know it and are bound by similar obligations, or when required by law. These obligations do not apply to information that is or becomes public through no fault of the receiving party, was already known to it, or is independently developed.

10. Third-party services

The Service relies on third-party providers, such as Stripe for payments and cloud infrastructure providers for hosting, as listed in our Privacy Policy. Your use of Stripe's payment services may also be subject to Stripe's terms.

11. Disclaimers

To the maximum extent permitted by law, AI-assisted features, including AI-assisted drafting (beta, not yet generally available) and any AI-generated drafts, are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. MCAG does not warrant that AI-generated drafts will be accurate or complete or will meet any specific regulatory, insurance or professional requirement; the licensed inspector remains responsible for the final report, as described in section 7.

12. Limitation of liability

To the maximum extent permitted by law: (a) MCAG will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or related to these Terms or the Service; and (b) MCAG's total liability arising out of or related to these Terms or the Service will not exceed the fees you paid to MCAG for the Service in the 12 months before the event giving rise to the claim. These limits apply regardless of the theory of liability and even if MCAG was advised of the possibility of such damages.

13. Indemnification

You will defend and indemnify MCAG against third-party claims arising from your Customer Content, your reports, or your use of the Service in violation of these Terms or the law, and you will pay resulting damages, costs and reasonable attorneys' fees.

14. Termination

You may stop using the Service and cancel your subscription at any time, as described in section 4. We may suspend or terminate your access if you materially breach these Terms, fail to pay fees, or if required by law, with notice where reasonably practicable. On termination, your right to use the Service ends, and we handle your data as described in our Privacy Policy. Sections 6 through 13, 15 and 17 survive termination.

15. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in Florida, and each party consents to the jurisdiction of those courts.

16. Changes to these terms

We may update these Terms from time to time. We will post the updated Terms on this page and change the effective date above. If a change is material, we will give reasonable notice, such as by email to account holders, before it takes effect. Continued use of the Service after the effective date means you accept the updated Terms.

17. General

These Terms are the entire agreement between you and MCAG about the Service. If any provision is held unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
